CRIMINAL CASES

People v. Fraser (2021)

 Defendant charged in Oneida County with Murder in the Second Degree.  After jury trial, acquitted on all charges.

People v. Brown (2018)

 Defendant charged in Oneida County with Murder in the Second Degree.  Despite numerous eyewitnesses jury acquitted on all charges.
People v. Conley (2017)
 Defendant charged in Oneida County with Murder in the Second Degree.  Decedent was a popular chiropractor, wife and mother. Jury found my client Not Guilty of Murder.
People v. Irwin (2016)
 Defendant charged in Oneida County with Murder in the Second Degree.  Pled to unlawful imprisonment and sentenced to time served.
People v. Bratge (2017)
 Defendant charged with Endangering the Welfare of a Child after being accused on inappropriate contact with a minor. Client was acquitted of all charges after a bench trial .
People v. Scheidelman (2017)
 Defendant was convicted in Oneida County Court of sexual abuse in the first degree. Upon appeal, the Appellate Division, Fourth Department reversed the judgment and granted a new trial.
People v. Murray (2017)
 defendant was sentenced to an aggregate minimum sentence of 6 years and an aggregate maximum sentence of 18 years following his conviction on Grand Larceny charges. Upon appeal, the Appellate Division, Fourth Department reduced his sentence to 3-9 on the grounds that the original sentence was unduly harsh and severe.
People v. O'Toole (2015)
 Defendant pled guilty in Oneida County Court to Robbery in the First Degree and Burglary in the Second Degree and was sentenced as an adult to eight years. Upon appeal, the Appellate Division Fourth Department reversed his conviction, vacated the conviction and adjudicated him a Youthful Offender.
People v. Otts (2009)
Defendant charged in Onondaga County with Murder in the Second Degree.  Decedent was 18 year old college student with heavy spectator support. Jury found my client Not Guilty of Murder on a justification defense. 
People v. Petterson (2009)
Defendant charged in Oneida County with seven counts in connection with Medicaid fraud.  Case was prosecuted by State Medicaid Fraud Unit.  following a jury trial my client  found not guilty of Grand Larceny .and first-degree Falsifying Business Records.
People v. Diggs (2008)
Defendant charged with double homicide, caught on video.  Aggressive pursuit of justification defense led to plea to one count of manslaughter.
People v. Montanez (2000)
Defendant charged with Murder in the Second Degree in Oneida County. Not guilty of Murder 2°
People v. Robinson (2001)
Defendant charged with Murder in the Second Degree in Oneida County.  Hung jury led to plea to manslaughter 2 °
People v. Long (1999)
Defendant charged with Murder in the Second Degree in Oneida County.  Following jury trial, client was found not guilty of all charges.
United States v. Oneida Research Services (1998)
Represented company president charged federally with defrauding government on testing Government products.  Indictment dismissed after trial that ended in hung jury..
United States v. Gilkeson (2005)
Defendant was charged in connection with a Federal indictment listing charges related to child pornography.  Following a suppression hearing during which I argued that the search of defendant’s computer violated his constitutional rights, the presiding judge suppressed all evidence seized and the Federal charges were dismissed. 
United States v. Littlefield (2007)
Defendant was charged in connection with Federal indictments listing charges related to child pornography in the Western District of New York and the District of Massachusetts.  
People v. White (2010)
Defendant charged with Murder in the Second Degree in Oneida County.  Following legal arguments,  murder charge dismissed, plea to gun charge.
People v. Jones (2009)
Defendant charged with Murder in the Second Degree in Oneida County.  Murder charge dismissed.
People v. March (2010)
Defendant charged with Murder in the Second Degree in Oneida County.  Murder charge reduced to manslaughter, gun charge due to justification defense.
People v. Mahardy (1995)
Client indicted on 15 counts of  weapons possession, all counts dismissed upon legal arguments.
People v. Darrow (2002)
Client charged in Herkimer County with Endangering the Welfare of a Child.  Upon motion to dismiss for facial insufficiency, all charges dismissed
People v. Barefoot (2009)
Client charged in Oneida County with Criminal Contempt for ignoring a Grand Jury subpoena. Upon motion to dismiss for facial insufficiency, all charges dismissed
People v. Ketchum (2003)
Defendant charged with numerous charges stemming from a false accusation that he abused his stepdaughter. After successfully getting polygraph results before the presiding judge, client was found not guilty of all charges after a bench trial.
